Having a Fiduciary

Means that your agent is personally responsible to act in your best interest to include purchase price, concessions, inspection items, property inclusions, and other contingencies. The State of Colorado does not allow dual agency transactions which means that a listing agent can't have fiduciary responsibility to both their client on the sell side and you on the buy side. This means the listing agent will become either a transaction broker, with no fiduciary responsibility to either party, which is usually impossible if they've already entered into a fiduciary relationship with their client, OR, the listing agent will interact with you solely as a customer, which means they have no responsibility to you at all and they're obligated to get the best deal for their client and will not be able to consult you through the process with deadlines and inspection reports.
